1. Acceptance of Terms

By accessing or using the Alfe platform (“Service”), operated by Alfe Pty Ltd (ABN 20 694 686 765) (“Alfe”, “we”, “us”), you agree to be bound by these Terms of Use. If you do not agree, you must not use the Service.

These terms apply to all users of the Service, including the website at alfe.ai, the dashboard, the mobile application, and any AI agent services provided through the platform. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

2. Eligibility

You must be at least 18 years of age to use the Service. By creating an account, you represent that you meet this requirement and that all information you provide is accurate and complete.

3. Account Registration

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must notify us immediately at hello@alfe.ai if you become aware of any unauthorised use of your account.

4. Service Description

Alfe is an AI agent platform that enables users to create, configure, and deploy AI-powered assistants. The Service includes:

• AI agent creation and management
• Integration with third-party services (Slack, Discord, Google Workspace, Microsoft Teams, and others)
• Voice and text communication channels
• A dashboard for monitoring and configuration
• A mobile application for on-the-go management

5. Billing and Credits

The Service operates on a credit-based billing model. Credits are purchased in advance and consumed as you use platform features. Key billing terms:

• Credits are denominated in USD and are non-transferable between tenants
• Credit consumption is based on usage of AI models, voice synthesis, compute resources, and other services
• Subscription fees are charged on a recurring basis as selected during sign-up
• Consumed credits are non-refundable
• Unused credit balances may be refunded at our discretion upon account closure
• We reserve the right to adjust pricing with 30 days’ notice

All payments are processed by Stripe. By providing payment information, you authorise us to charge your selected payment method in accordance with your subscription and top-up settings.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Generate, store, or distribute illegal, harmful, or abusive content
• Impersonate any person or entity, or misrepresent your affiliation
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Interfere with or disrupt the Service or the servers and networks connected to it
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to build a competing product or service
• Circumvent any usage limits, billing mechanisms, or access controls
• Use AI agents to spam, harass, or deceive others

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these terms.

7. AI-Generated Content

The Service uses artificial intelligence to generate responses, perform tasks, and interact with users and third-party services on your behalf. You acknowledge that:

• AI-generated outputs may not always be accurate, complete, or appropriate
• You are responsible for reviewing and verifying AI-generated content before relying on it
• AI agents act based on their configuration and training — you are responsible for how your agents are configured
• We do not guarantee any specific outcome from AI agent interactions

8. Intellectual Property

Our Property

The Service, including its software, design, documentation, and branding, is owned by Alfe Pty Ltd and is protected by intellectual property laws. Nothing in these terms grants you any right to use our trademarks, logos, or brand elements.

Your Content

You retain ownership of all content you create, upload, or provide through the Service, including agent configurations, conversation data, and files. By using the Service, you grant us a limited licence to process your content as necessary to provide and improve the Service.

9. Third-Party Integrations

The Service enables connections to third-party platforms. Your use of those platforms is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

11. Limitation of Liability

To the maximum extent permitted by law, Alfe Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising from or relating to these terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Alfe Pty Ltd, its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

13. Termination

You may close your account at any time by contacting us. We may suspend or terminate your access to the Service at any time for any reason, including violation of these terms, with or without notice.

Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

14. Changes to These Terms

We may modify these Terms of Use at any time. We will notify you of material changes by posting the updated terms on our website and, where appropriate, by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms.

15. Governing Law

These terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from or relating to these terms or the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales.
